Upcoming Event: 11th July 2019 – Association versus Causation: Epidemiology versus the law?

This conference will bring together leading medical and scientific experts with practising and academic lawyers. The intention is to bring some clarity and coherence to the controversial subject of the use of epidemiology in proof of causation in tort litigation.

This issue has been discussed inconclusively in leading cases in particular Sienkiewicz –v- Greif and Williams –v- Bermuda.

The conference will follow an interactive format with case studies illustrating the difficulty in the practical application of epidemiological data drawn from cohorts to specific causation
in litigation.

Consideration will be given to the relevance and application of doubling of risk. This will be followed by open sessions discussing the case studies and attempting to agree propositions relevant to the application of epidemiology. The hope of the conference organizers is that these propositions will provide some authoritative guidance in this context.

Resolution Through Mediation – Charles Feeny

Charles Feeny writes in the May 2019 issue of Liverpool Law:

In April 2017, the National Health Service Litigation Authority (NHSLA) changed its name to NHS Resolution. This was not meant to be a nominal re-brand. It represented an aspiration to achieve what might be described
as a more holistic response to medical accidents. The new approach was taken in conjunction with other initiatives such as duty of candour and patient safety. Whilst the more jaundiced clinical negligence litigators viewed this development with some scepticism, there can be no doubt that the process of change has been approached with serious intent.
